Florida’s new proposed texting while driving law faces roadblocks

TALLAHASSEE, Fla. — The State Senate Transportation Committee debates whether to make it possible for police to pull over drivers, simply for texting while driving. Current law requires texting to be a secondary offense in any traffic stop.

But since the U.S. Supreme Court ruled that it takes a warrant to search a cellphone, it could be problematic for police to prove their case.

Also, lawmakers on Wednesday will consider whether to expand the bill to include other uses of cellphones like Googling or checking email.

It is not against Florida law to talk on a cellphone while driving.
