O’Dell said Miller is a Marine veteran who was recently placed under the Baker Act by the Osceola County Sheriff’s Office.
Channel 9 Legal Analyst Bill Sheaffer said that baker act, or any other mental health issues, will not affect Miller's prosecution on the first degree murder charge -- unless an evaluation determines he was insane at the time of committing the crime.
But any mental health issue could be weighed during sentencing, if Miller is convicted, Sheaffer said.
Police said Miller was taken to the Osceola County Jail in Baxter's handcuffs.
